Transporters are experiencing substantial delays at the weigh-bridges in Zambia when transiting to and from DRC. To make matters worse trucks get weighed at more than one weigh bridge even though the drivers have copies of the initial weigh bridge slips showing no overloads. |
|
|
Resolution status note:
|
Zambia reported that the Road Development Agency (RDA) was acting within the law (The Tolls Act of 2011). As a result, trucks are continuously weighed to ensure that no extra loads are added onto the trucks. There is an going process to designate weigh bridges for international truckers as part of the vehicle load management programmes being implemented under the tripartite .Delays in the weighing process are only occasional and not every time. A normal weighing process takes 3 to 5 minutes depending on the details being submitted. All the trucks were cleared and therefore the matter is resolved |

Haphazard breaking of seals at Beitbridge Border without any proof of authentication. Customs officials are breaking the transit cargo seals on the containers and merely crossing out the seal on the manifest and replacing it with the temporary seal. This has severe implications as these containers have already been fumigated and opening the container compromises the fumigation process and leaves the load susceptible to tobacco beetle cross infestation at the border. As there is no authenticity/customer number/stamp endorsing the seal change it means that anyone could have tampered with the cargo on route and this possess another issue with our customers in the USA as it contravenes their anti terrorism procedures . There was legislation passed by ZIMRA in terms of SI 113 of 2017, the Customs and Excise (General) Regulations, SI 154 of 2001, Section 60 that states no seals should be opened in transit through Zimbabwe in order to improve the management of transit cargo. This new legislation needs to be passed on to the officials at Beitbridge (Zimbabwe side)as they are still breaking seals at the border. |
|
|
Resolution status note:
|
During the meeting of the NTBs Focal Points held on 19-21 August 2019, Zimbabwe Focal Point confirmed the ZIMRA report below that, transit trucks which are picked by the system for Physical Examination (P/E) are referred to the container depot for P/E. The majority of these trucks are P/E waived.
Where a physical examination is conducted broken seals are replaced and the replacing seals are endorsed on the manifest and the office stamps and signs.
The above is the same procedure on both imports and exports.
Where trucks are not referred for P/E the trucks are either escorted or sealed with electronic seals.
When trucks are escorted no seals are broken.
There are instances when the container has seals on all openings and ZIMRA break the other seal in order to place their electronic seal. In such a case appropriate endorsement is made on the manifest.
There could be some cases probably where officers have not done this hence the complaint from the client. ZIMRA however does not have a point of reference since a particular case has not been cited.
ZIMRA management have reminded all officers to ensure that whenever a seal is broken the appropriate endorsement is be done. |

Kenya is facing challenges with the delays in verification of perishable goods namely industrial gases and milk products. Industrial gases are exported in liquid state but they very quickly evaporate into gas if the export trucks are left out in the open sun for more than 48 hours. Also, milk is a sensitive product which if not preserved in conducive environment it will get spoiled therefore, should be treated as perishable products under special clearance. |

Resolution status note:
|
During the 27th RMC meeting, the Republic of Burindi reported that transit goods which have spent more than 30 days in Tanzania are charged VAT, when they exit. The Republic of Burundi resubmited to the Secretariat the evidence that was submitted to the United Republic of Tanzania. The United Republic of Tanzania informed the meeting that the fee is charged on services rendered to the trader after the 30 days of the grace period and these services are taxable. The United Republic of Tanzania informed the Sectoral Committee on Trade that as per the evidence given the fee is charged on services rendered to the trader but not on the transit goods after expiry of the 30 days of the grace period and these services are taxable. Hence the United Republic of Tanzania considered the issue not qualifying to be an NTB. Hence the issue was resolved. |

Kenya and Tanzania have installed the High Speed Weign In Motion Weigh Bridges (HS-WIM).
Number of Weigh Bridges in Partner States are as follows: Burundi: 0, Kenya: 4, Rwanda: 0, Tanzania: 3 as agreed, Uganda: 2
The meeting recommended that Uganda be urged to consider installing High Speed Weigh-In Motion Weigh Bridges to resolve this NTB.

We have a fleet of trucks and the problem is there is no fixed procedure to calculate the toll that BURS charges. They see the weights on the trailers mentioned on the blue plates which many a times shows 36,000kgs on the small trailer and 36,000 on the big trailer. That means they charge each truck toll for 72000 kgs. Some trailers with the same load and same trailers end up paying 4200Pulas and some trailers with the same cargo and same type of trailers are told to pay 6700 pulas. When the agent goes to ask that if you are charging us for 72000kgs will you allow the truck to carry such weights. They just tell him to leave the office and say there is no negotiation. We fail to understand how 1 truck having the same trailer and same cargo pay 4300 pulas and other truck with same trailer and same cargo is told to pay 6700 pulas. This on our transporters part is unfair. They should come with a fixed charge option that trucks with tri axel trailers will pay this much and trucks with interlinks trailers will pay this much. Please we will be obliged if this issue is raised on top priority. |
|
|
Resolution status note:
|
In this particular case, there was difference in weights between those indicated in the white book and the data plate affixed to the truck. Assistance was sought from the Weighbridge and due to other circumstances the attempt was unsuccessful. In concluding the query, the truck driver was assisted using the previous permits which he had no objections to.
The inconsistency with information from the trucker resulted in the inconsistency of the charges. This was resolved. |

There is a disruption in the flow of trade/transit at Nakonde/Tunduma border post due to a protest by transporters in Tanzania who are not moving cargo across the border. This has affected the movement of goods both into Zambia and Tanzania and has resulted in increased congestion on both sides of the border. Considering the important role the Nakonde/Tunduma border post plays along the transport corridor, any further delays resulting from the protests will significantly disadvantage all stakeholders within the region in terms of revenue and costs. This will ultimately have a negative effect on the consumer welfare in the countries and the region at large. It is therefore imperative that the present impasse is resolved as a matter of urgency. |

The Ministry of trade took action by canceling the Certificate of Destination to allow the flow of goods to the county, However the action was not honored by the RSS Customs office in Mombasa, reported by Kenya International Freight & Warehousing Association (KIFWA), National Chamber did meet with the RSS Minister of Finance to look at the matter and he promise to communicate to the Revenue Authority since he is not aware of the new regulation and the charges imposed. With the mounting pressure from the stakeholders National Revenue Authority send a letter to Kenya Revenue Authority and Kenya Port Authority to support the flow of goods to South Sudan unrestricted and the Minister of trade order is to be honored as per NRA letter, lastly on 21st December the official at Customs RSS in Mombasa started releasing the cargo to RSS with only $50 Charges not those mention on the Certificate of Destination Chagres below:-

2- 20ft Container $365
3- Vehicle 4x4 $365

Issuance of exorbitant transit permit fees by the Zambian Government went up from K3700 to K11200 and is only imposed at the Katima Mulilo Border post and not at any other borders around Zambia. The Permit was supposed to only apply to those entering Zambia for the purpose of doing business and not those in transit such as drivers transporting the goods through/via Zambia. the permit is therefore deemed to be discriminatory (no other SADC/COMESA countries are imposing a similar measure)and, the permit hinders the movement of goods as truck drivers are delayed in trying to source money to fund the permit. |

This change brings about healthy and safety concern to drivers. Drivers are concerned on road conditions, mechanical faults and time to rest on the road which makes it difficult to meet this newly set time limit.
