Complaint: We are a South African Transport Company transporting goods into DRC. We are paying on weekly basis exorbitant road duties in Botswana, Zambia, and Zimbabwe & DRC if we offload loads from Johannesburg RSA to Mutanda DRC. Our cost on a tri-axle on road fee is 1060 Pula on return trip (Martinsdrif to Kazangula and back), insurance 50P for 3 months and then about 100 Pula on a yearly level also. Zambia insurance 300 000KW for year, then toll fee for 285USD on return trip Kazangula to DRC border and back, 200 000KW carbon tax, 70 000KW for extra toll fees on road. Zimbabwe insurance 170USD for year, the 100USD on toll fees, then coupons another 10USD and environmental cost depends on the load and weight up to 160USD & 90USD carbon 3 months. Going into the DRC, border customs parking 133USD, entry fee and costing 350USD, 300USD PEAGE, 4x 150USD for toll fees going to Mutanda and coming back.
None of the foreign trucks from DRC, Zambia, Zimbabwe, Botswana or Namibia pay this cost when entering South Africa. We drive on the roads to supply clients with goods, we provide a service, the same as for the foreign transporters, but they don't pay similarly high costs when entering South Africa. We need an explanation from the countries listed above as to why is this done. At the moment, we give to a driver for one load going to DRC from JHB, 2400USD, 2500 PULA & R5000 to cover these expenses and we cannot increase our rates easily, without risking losing our clients. What can be done about this situation?
 
Resolution status note: Focal Points from Botswana, Zambia and Zimbabwe reported the current standard official charges and argued that these are in accordance established regional protocols. At the 11th meeting of the SADC Sub -Committee on Trade Facilitation held on 23 May 2013, South Africa focal point requested that the NTB be considered non actionable as they could not trace the complainant.

However, the NTB is considered resolved as it does not fall under the ' non actionable' category of complaints.

Complaint: Note: This is not reported by South Africa, but by FESARTA; a sub-regional organization.
The South African National Roads Agency, SANRAL, is planning to introduce new toll fees on its upgraded Gauteng freeways (E-tolls). The proposed fees are in excess of fees agreed at regional level, viz:
In 2007, the SADC-recommended road user charge for South Africa, was US$2.92/100kms, for a heavy goods vehicle. In 2009, this was revised to US$3.46/100kms. These recommended figures were calculated from the road maintenance data submitted to SADC by South Africa in those years.
On its busiest freeway, the N3 from Durban to Gauteng, the 2012 toll fees charged by SANRAL amount to approximately US$13/100kms. This is far in excess of the fees recommended by SADC.
Now, SANRAL is proposing to charge around US$19/100kms for the use of the Gauteng freeways by a heavy goods vehicle.
It is considered that these fees are excessively high and will unnecessarily add to the cost of goods to the consumer in the East and Southern African region.
 
Resolution status note: At its 11th meeting of the SADC Sub -Committee on Trade Facilitation held on 23 May 2013 in Gaborone, SCTF noted that the report was based on toll fees that were not yet implemented. As such traders are not affected. It was agreed that matter be filed until such time that the fees are effected

Complaint: Kenyan Trucks entering into Tanzania are charged a levy of US$ 200 each  
Resolution status note: At the Tripartite NTBs Online Reporting, Monitoring and Eliminating Mechanism Meeting to Launch the SMS Reporting Tool held from 9-10 April 2013 in Lusaka, Zambia, Tanzania reported that the $200 Charged on all Tracks entering Tanzania had been abolished abolished effectively from June 2012 and instructions had been sent to all posts to stop charging this levy.

Complaint: Kenyan Trucks entering into Tanzania are charged a levy of US$ 200 each  
Resolution status note: At the 12th Regional Forum on NTBs held from 14th – 17th, October 2013, at EAC Headquarters, Arusha, Tanzania, and United Republic of Tanzania reported that the USD 200 levy on Kenya trucks was abolished in June, 2012.

Complaint: This complaint is registered by FESARTA.
Transporters are being charged a motor vehicle fee by Siavonga Municipal Council. There is no justification for such a fee since the transporters do not receive any services from the Council. The transporters are travelling on national roads, which are maintained by the government and not the Council. The transporters pay road user charges to the government to maintain the roads.

Resolution status note: Zambia advised that all Levies collected by the Council are guided by Section 69 and 70 of the Local Government Act CAP 281 of the Laws of Zambia which specifies the Levies to be collected. Under this Act (CAP 281), no Council is mandated to collect motor vehicle fees. The measure shall be uploaded onto the online NTMs database .

Complaint: Tanzania Truck Owners Association (TATOA) reported that Tanzania Trucks, after delivering a consignment they carried from Tanzania to Congo, are charged $100,000/= per truck if they want to carry another consignment on their way back to Dar es Salaam. The attached receipt is just evidence for one transaction but there are other transporters who have paid such charges while there are also other transporters whose vehicles have been detained until now. This fee is charged at KIPUS mine in the name of LOCAL INCOME TAX WHILE LOADING CARGO. Tanzania regards this as an NTB and she needs to know the reason for charging such a huge amount of money from transporters. DRC focal point is requested to treat this matter as urgent since a number of tracks are still detained at Kipus Mine in the D. R. Congo.  
Resolution status note: On 08 October, Tanzania focal point reported that the DRC released the trucks held at the KIPUS Mine . This NTB is therefore considered resolved.

Complaint: This complaint is registered by FESARTA.
The Zimbabwean Ministry of Transport and Infrastructure is levying a toll of US$30 per trip, for the crossing of the Victoria Falls bridge. Ref: SI 171 of 2012.
This toll is not justified because it was never discussed with those who are having to pay the toll and there is no reconciliation for the amount of the toll.
Furthermore, transporters pay road user charges, which are to cover the wear and tear caused to the roads and bridges.
 
Resolution status note: On 13th September 2016, FESARTA advised that the transporters were no longer facing this barrier so the NTB is resolved.

Complaint: A Malawian transport company was charged an exorbitant fee of 10, 000 Meticais for expired insurance for horse only between Pungue and Mafambise in Mozambique. This has happened a number of times. Can Mozambique authorities confirm the fee and also provide other relevant information on transit fees, fines and penalties. Information on the various charges and or transit fees is not available for transporters using Mozambique roads along the Beira route.  
Resolution status note: On 18 June 2013, Mozambique focal point submitted a copy of the Decree No. 26/2010 of 14 July 2010 outlining the road user fees applied on Mozambican roads as per Malawi request. This NTB is therefore considered resolved

Complaint: There is a charge only on foreign vehicles over 3500kg crossing the Tete bridge initially US$250 and then US$75 every time the vehicle crosses the bridge. The vehicle involved is a Crane truck used in construction sites in and around Tete.
The vehicle can travel all the way from Maputo and operate on the south side of the river without paying any fees but is charged the above very high fees once it goes to the north side of the bridge.
 
Resolution status note: On 10 February 2015, Mozambique focal point reported that the fees are regulated through the Decree No. 26/2010 available in the online system and that the USD75 fee is only applicable to cross the north bridge. According to the decree establishing the rates, foreign vehicles must pay a stipulated fee of 75 USD on the bridge. However, as indicated by complainant, the vehicle can use alternative route and travel all the way from Maputo and operate on the south side of the river without paying any fees. With this explanation, Mozambique considers the NTB resolved because there is alternative route for foreign vehicles.

Complaint: This complaint is registered by FESARTA.
Zambia is to introduce toll fees for all road users, on 1st November 2013.
The structure of the fees is detailed in the attachments.
The introduction is considered an unfair practice, since the tolls apply to foreign vehicles, and these vehicles pay road user charges on entry into the country.
The road user charges that the foreign vehicles pay (between USD10 per 100 kms and USD16 per 100 kms), are set to cover the road usage cost by the vehicles as they travel the country's roads.
The level of road user charges was recommended by COMESA, of which Zambia is a member.
Updated road user charges are being developed by the COMESA/EAC/SADC Tripartite and, when finalized, will be disseminated to member countries for their implementation.
Thus there is no justification for Zambia to introduce toll fees for foreign vehicles, as it is a duplication of the road user charges paid by them on entry into the country.
The added fees mean that foreign vehicles will be paying more than their fair share for road usage, and merely add to the cost of goods consumed in landlocked countries.
 
Resolution status note: On 31st March 2016, Zambia Focal Point reported that Toll fees are charged once at the port of entry for road usage from one point to the other and back. Transporters are only charged extra if they divert from their original route. The toll fees are discriminatory.

Complaint: Egypt's National Monitoring Committee received a complaint from Chemicals and Fertilizers Exporting Company that the cost of shipment between Egypt and the eastern countries in Africa is very high. In addition east African countries prefer that the shipment companies ship fruits rather than chemicals. And hence a suggestion was made to hold a meeting between transport syndicates especially of the landlocked countries in COMESA and the business community in an attempt to reach a solution.

please consider the above mentioned suggestion.
 
Resolution status note: On 8th February 2016, Egypt Focal point reported that the NTB be considered closed on the basis that Egypt's National Monitoring Committee did not receive any details from the Exporting Company.
