- 5. (1) A person shall not import plant, plant product and regulated article unless
(a) he has obtained an import permit granted by the National Plant Protection Organization; or
(b) he has an original Phytosanitary Certificate issued by National Plant Protection Organization of the exporting country.
(2) Notwithstanding subsection (1),the National Plant Protection Organization may exempt a plant, plant product or regulated article from the requirements of obtaining an import permit or phytosanitary certificate upon written approval by the Authorized Officer.

- 2. (1) Subject to this Order—
(a) no plant; and
(b) no seed of any plant specified in the First Schedule, shall be imported into Kenya except under and in accordance with the conditions of a permit previously obtained from, and signed by, the Director of Agriculture or an officer of the Ministry of Agriculture authorized by the Director of Agriculture for the purposes of this Order.
(2) Notwithstanding the provisions of this paragraph but subject to the provisions of any other written law, any plant and the seeds of any plant may be imported without a permit if such plant was grown in and is exported from Tanzania or Uganda or such seeds were taken from such plant: Provided that this sub paragraph shall not apply in respect of any plant or the seeds of any plant specified in the Second Schedule.
3.All applications for permits shall state—
(a) the full name and address of the applicant;
(b) the name and address of the person or firm from whom the plants or seeds are to be obtained;
(c) the names and quantities of the plants or seeds to be obtained;
(d) the name of the farm or estate on which the plants or seeds are to be planted and the district in which it is situated.
12. No living insects or invertebrate animals in any stage shall be imported except by virtue of a permit previously obtained from and signed by the Director of Agriculture and under the conditions stated in such permit.
13.Any person who contravenes or fails to comply with any of the provisions of this Order shall be guilty of an offence and liable to a fine not exceeding two thousand shillings or to imprisonment for a term not exceeding two months. - Reference of the measure

- 3. Restrictions on importation, manufacture, selling, etc
(1) No person shall import, manufacture, compound, mix or sell any fertilizer or animal foodstuff other than a substance declared by rule made under section 19 of this Act to be an approved fertilizer or an approved animal foodstuff, as the case may be.
(2) No person shall import, manufacture, compound, mix or sell any fertilizer or animal foodstuff in respect of which rules have been made under paragraph (a) of subsection (1) of section 19 of this Act unless the fertilizer or animal foodstuff conforms to the standard or specification prescribed by such rules: Provided that it shall be a sufficient defence for anyone charged with importing or selling in contravention of this subsection to show that—
(i) he imported or purchased the fertilizer or animal foodstuff under a name or brand the subject of a declaration pursuant to subsection (1)of this section, as being the same in all respects as the article which he had ordered or, as the case may be, which he later purported to sell; and
(ii)he had no reason to believe at the time of importation or sale that it was in any respect different from such article; and
(ii) the container thereof was branded, labelled, marked or sealed in the prescribed manner; and
(iii) in the case of a sale, he sold it in the original container and in the state in which it was when he imported or purchased it.
