Complaint:	A number of non-tariff fees are levied on agricultural and manufactured products. Examples are: inspection fees, Warehousing fees; Air Cargo levy; Agricultural Cess, Livestock Marketing Cess, landing and parking fees, seaman's levy and farm support fees.
Resolution status note:	The SADC Sub Committee on Trade facilitation carried out a review of long standing NTBs and found out that the various fees identified above, i.e. inspection fees, warehousing fees; air cargo levy; agricultural cess, livestock marketing cess, landing and parking fees, seaman's levy and farm support fees were acceptable as long as they are for the services rendered and are also provided for in the national legislations. This is finding therefore resolves the NTB

Complaint:	Extended and unpredictable turnaround time resulting in additional costs of trucking into Angola.
Resolution status note:	During the NTBs national workshop held in Angola on 30 November 2011 it was reported that customs observations were that truck drivers leave trucks at the Angola borders for 3 or more days and return to Oshikango to resolve personal issues, claiming that they are processing documents. Too many trucks are parked at the border without information where the drivers are. In some cases drivers have reported that they are not clear of the physical addresses of destination of the load in Angola. Angola Customs is investing in creating the best conditions for commercial and non commercial border users. Santa Clara border is undergoing a massive expansion with a view to become a regional and international example of trade facilitation infrastructures.

Complaint:	DRC transit charges are too exhorbitant. For example, a truck delivering to Tenke, will have to pay $340 + 750 + 125 + 125 = $1340 for one return trip.That is, providing the truck doesn’t wait more than one day at the Zambian border. There have been many complaints about it, but little seems to be done. There are ongoing efforts by the RFA and other stakeholders to get the toll fees as low as possible yielded some positive resulted in a once off reduction of the fees which still are too high. Each trip through Kasumbalesa to Lubumbashi costs a staggering US$ 125.There is need for transparency and fair toll fees at regional level.

Complaint:	Zambia is enforcing a requirement under the CONSTRUCTION AND USE REGULATIONS OF THE ROADS AND ROAD TRAFFIC ACT CAP 464, SECTION 17 (2) OF THE SUBSIDIARY LEGISLATION imposing a fee of K180, 000 on all trucks using the Zambian roads without mud flaps , unless the truck or trailer is made in such a way that it can capture the mud, water and flying stones coming out of the wheels of the truck. This requirement is not imposed by all other countries on the transit routes. There needs to be understanding amongst member states that they be flexible with enforcement on foreign vehicles and accept those that have valid roadworthiness certificates from their countries of registration.
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012,Zambia clarified that the charge on trucks without mud flaps is applied on all vehicles, local and foreign and therefore not discriminatory. This is a legal requirement. It was resolved that this NTB be recorded under the schedule of ‘Resolved’ NTBs of policy and regulatory nature for further consideration

Complaint:	Malawi charges very high road leivies
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs,Malawi reported that it was difficult to get further information from the complainant as this was uploaded before the online system allowed complainants to provide their contact details. However, Malawi would consult with the Ministry of Transport to gather all the transport related charges and upload them on the NTB website, for transparency. It was resolved that this NTB could not be processed for now until such time South Africa provides adequate information on the complaint. In the meantime, the NTB would be considered resolved, until the agreed information is made available. South Africa requested that the NTB be transffered to the section for resolved NTBs of policy and regulatory nature since the regulations are in place in Malawi.

Complaint:	DRC is charging exorbitant fees which are not in line with SADC and COMESA harmonized fees.From 01/02/10 DRC did not reduce their tolls they instead greatly increases them. Road tolls in DRC are about 15 ( 1500 % ) times greater than the SADC recommended. Today a foreign transporter entering DRC at Kasumbalesa going to Tenke Fungurume mine ( 300 kms each way ) is subject to the following tolls and fees (distance of 300 kms into DRC and 300 kms out of DRC): Road toll Kasumbalesa/Lubumbashi return $ 300 ; Road tolls Lubumbashi/Likasi return $ 300; Road tolls Likasi/Tenke return $ 150 ; Government tax $ 50 ; Fumigation Fees $ 50 ; Card entry $ 15 ; Tourism/Vaccination fees $ 35 ; Visa for truck $ 25 ; Break bulk fees $ 20. Total cost to the transporter in Fees and Tolls is $ 945. That works out at $ 157.5 per 100 kms. The SADC agreed is $ 10 per 100 kms.

Complaint:	There are too many roadblocks along the major hoghways in EAC partner states. Too many stops points (police check points ) that cause unnessary delay of goods from ports to various destinations in the partner states.
Resolution status note:	On 15th May 2014, Kenya Focal Points reported that this NTB had been resolved. KRA abolished the requirement of Cash bonds as recommended by the EAC regional forum on NTBs and Council . What is required and applied is a general bond . Therefore the NTB should be recorded as resolved.

Complaint:	This complaint is registered by FESARTA. Zambia is to introduce toll fees for all road users, on 1st November 2013. The structure of the fees is detailed in the attachments. The introduction is considered an unfair practice, since the tolls apply to foreign vehicles, and these vehicles pay road user charges on entry into the country. The road user charges that the foreign vehicles pay (between USD10 per 100 kms and USD16 per 100 kms), are set to cover the road usage cost by the vehicles as they travel the country's roads. The level of road user charges was recommended by COMESA, of which Zambia is a member. Updated road user charges are being developed by the COMESA/EAC/SADC Tripartite and, when finalized, will be disseminated to member countries for their implementation. Thus there is no justification for Zambia to introduce toll fees for foreign vehicles, as it is a duplication of the road user charges paid by them on entry into the country. The added fees mean that foreign vehicles will be paying more than their fair share for road usage, and merely add to the cost of goods consumed in landlocked countries.
Resolution status note:	On 31st March 2016, Zambia Focal Point reported that Toll fees are charged once at the port of entry for road usage from one point to the other and back. Transporters are only charged extra if they divert from their original route. The toll fees are discriminatory.

Resolution status note:	At the 16th EAC regional forum on non tariff barriers held in Kigali in December 2014, Kenya reported that the port charges by ICDs and CFS should be the one approved by port authorities. Kenya Ports Authority has signed a service level agreement to guide charges by CFS. This NTB is therefore resolved.

Complaint:	There is a charge only on foreign vehicles over 3500kg crossing the Tete bridge initially US$250 and then US$75 every time the vehicle crosses the bridge. The vehicle involved is a Crane truck used in construction sites in and around Tete. The vehicle can travel all the way from Maputo and operate on the south side of the river without paying any fees but is charged the above very high fees once it goes to the north side of the bridge.
Resolution status note:	On 10 February 2015, Mozambique focal point reported that the fees are regulated through the Decree No. 26/2010 available in the online system and that the USD75 fee is only applicable to cross the north bridge. According to the decree establishing the rates, foreign vehicles must pay a stipulated fee of 75 USD on the bridge. However, as indicated by complainant, the vehicle can use alternative route and travel all the way from Maputo and operate on the south side of the river without paying any fees. With this explanation, Mozambique considers the NTB resolved because there is alternative route for foreign vehicles.

This has happened a number of times. Can Mozambique authorities confirm the fee and also provide other relevant information on transit fees, fines and penalties. Information on the various charges and or transit fees is not available for transporters using Mozambique roads along the Beira route.
Resolution status note:	On 28 October 2013, Mozambique Focal Point submitted Decree No. 26/2010 of 14 July 2010 stipulating the road user fees applied on Mozambican roads as per Malawi request.. The Decree has been uploaded onto the online system under Notifications.

Complaint:	charges for carbon tax and insurance affecting our traveling costs that needs to be removed for easer movement
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012, Zimbabwe explained that charging carbon tax and insurance are standard procedures in the SADC region. There is no violation of SADC or COMESA regulations. A carbon tax is for the protection of the environment therefore this NTB should be considered resolved. 1. Botswana requested that Zimbabwe provides the available information on the specific fees and or charges specifying whether the charges are per trip or for the whole year. 2. It was agreed that this NTB should be considered resolved once Zimbabwe has provided the requested information.
