Complaint:	Too much time is lost during cross border pre-shipment inspection and certification for Kenyan bound cargo.
Resolution status note:	At the NMC meeting held in Nairobi on 29 August 2011, Kenya reported that KRA is currently carrying out time release study to determine time taken at borders. 2. EAC is in the process of introducing OSBP.

Complaint:	In Kenya, police can claim that a container is security risk and arrest it until customs people come.

Complaint:	Kenya is not calibrating the weighbridges; therefore there is use of different weights. Leading to rampant Bribery activities taking place at the weigh bridges

Complaint:	Unreliable, different readings on the internal weighbridges in Tanzania, Kenya, Uganda, Rwanda and Burundi. Readings can differ as much as between 500-700kgs resulting in transporters paying unnecessary huge fines. Weighbridges are often verified, however, various factors which include technical faults of the instruments and unscrupulous conduct of the transporters sometimes result in false readings: This problem relates to transit goods in properly sealed containers that, under normal circumstances, cannot be opened before they get to destination.

Complaint:	The process of obtaining DRC Ogeframe certificate delays cargo at the port and increases costs. Procedure is too long as it involves exporter paying fees at Tanzania Revenue Authority in DAr es Salaam Office and then take the document for endorsement by DRC. This is applicable only to transit goods to DRC.
Resolution status note:	Member States agreed to resolve on the strength that no complaints had been received .

Complaint:	The Ministry of health in Zambia issued a notice under Food and Drugs Act Cap 303 of the Laws of Zambia for all importers of food products into Zambia and those transiting to other countries to obtain Health insuarance certificates. All transit trucks loaded with food stuff and beverarages must obtain this permit which is only issued in Lusaka and takes upto 10 days. This short notice has resulted in all the trucks carrying this kind of cargo getting stuck in Nakonde adding to more delays than what already being experienced at Nakonde . What is odd is that why should transit trucks have to obtain these permits ? Can something be done about this urgently to avoid huge pile ups of trucks at Nakonde please ?
Resolution status note:	Zambia reported that there is no Health insurance certificates but health clearance certificate under cap 303 and this requirement has always been there except Nakonde border post previously was operating without following these requirements until recently when they are working towards normalizing its operations. These certificates are only issued in Lusaka but efforts are being made to build capacity at provincial levels so that the system can be decentralized. This is in the plan for this year, 2011.

Complaint:	On a number of occasions, Kenyan customs demands that products originating from Tanzania have to be unloaded for physical verification, which means destruction of the product packages. The importer has thereafter to repackage goods at own cost so as to fit original packages. Products most affected include tyres, textiles, cognac spirits and cigarettes.

Complaint:	South Africa places adhoc requirements on the importation of perishable goods in the form of standards
Resolution status note:	Soth Africa reported that compulsory specifications for perishable goods are aimed at ensuring the health and safety of the consumer and fair trading practices. The relevant internationally recognised Codex Standards and Codes of Practice are used as a basis for these compulsory specifications. Documents from Codex are specifically referenced by the WTO-SPS Agreement.

Complaint:	There are too many roadblocks along the major hoghways in EAC partner states. Too many stops points (police check points ) that cause unnessary delay of goods from ports to various destinations in the partner states.
Resolution status note:	On 15th May 2014, Kenya Focal Points reported that this NTB had been resolved. KRA abolished the requirement of Cash bonds as recommended by the EAC regional forum on NTBs and Council . What is required and applied is a general bond . Therefore the NTB should be recorded as resolved.

Complaint:	Police officers at the Kirumu check point are harrassing Truckers bringing goods to Tanzania through Sirari border post. The harrassment is associated with attempts to solicit for bribes. Truck owners claimthat although they usually have all the customs receipts pertaining to the merchandise they are carrying, police officers have continued to hassle them for no apparent reasons.
Resolution status note:	At the NMC meeting held in Nairobi on 29 August 2011, Kenya reported a necessary disciplinary action had been taken to address this problem.

Resolution status note:	Burundi and Rwanda NMC consultations held during the 3rd meeting of the Tripartite NTBs Focal Points and NMC Chairs in Dar-es-salaam on 19-20 April 2012 concluded that the issue had been resolved after Rwanda bureau of standards recognised that Burundi water meets international standards.

Complaint:	Delays by Partner States to harmonize SPS protocol has resulted in cut-flower from Tanzania for re-exports to Europe and Russia blocked by Kenya.
Resolution status note:	At the 16th EAC regional forum on non tariff barriers held in Kigali in December 2014, Kenya reported that the blockage had been lifted. This NTB is therefore resolved.

Complaint:	Tanzania Truck Owners Association (TATOA) reported that Tanzania Trucks, after delivering a consignment they carried from Tanzania to Congo, are charged $100,000/= per truck if they want to carry another consignment on their way back to Dar es Salaam. The attached receipt is just evidence for one transaction but there are other transporters who have paid such charges while there are also other transporters whose vehicles have been detained until now. This fee is charged at KIPUS mine in the name of LOCAL INCOME TAX WHILE LOADING CARGO. Tanzania regards this as an NTB and she needs to know the reason for charging such a huge amount of money from transporters. DRC focal point is requested to treat this matter as urgent since a number of tracks are still detained at Kipus Mine in the D. R. Congo.
Resolution status note:	On 08 October, Tanzania focal point reported that the DRC released the trucks held at the KIPUS Mine . This NTB is therefore considered resolved.

Complaint:	Nakonde District Council of Zambia has introduced new Council Levy for external trucks entering Zambia in addition to other existing charges and levies.
Resolution status note:	On 25 August 2016, Zambia Focal point reiterated the fact that all Levies collected by the Council are guided by Section 69 and 70 of the Local Government Act CAP 281 of the Laws of Zambia which specifies the Levies to be collected. Under this Act (CAP 281), no Council is mandated to collect motor vehicle fees. This is therefore a policy measure notified to stakeholders . The NTB is considered resolved because stakeholders have been made aware of the regulations . The same will also be contained in the NTMs database.
