Complaint: Permits are issued by diffrent authorities in diffrent cities. Agricultural import permits are issued by NAMBOARD in Manzini.; Dairy products imports are issued by Dairy Board in Manzini. Other miscellaneous goods import permits issued by Ministry of Finance in Mbabane.  
Resolution status note: On 21st December 2015, Uganda Focal point reported that this NTB had been long resolved. Uganda received a letter from Swaziland indicating that the issuance of permits had been streamlined.

Complaint: Import licences procedure is cumbersome. Different departments issuing licences for different products. The multi-departmental authorisation is cumbersome and the procedures are too long.  
Resolution status note: Lesotho reported that this is no longer the case because One Stop Business Facilitation Center has been established. Almost all licensing departments from different ministries have been housed under one roof.

Resolution status note: .The NTBs meeting of Focal Points held on 19- 21 August 2019 was informed that the EAC agreed to harmonise the operations of their institutions. This NTB no longer was resolved in the EAC Time Bound mechanism.

Complaint: Zambian Ministry of Public Works has different operating hours compared to other border agents. On the 19th of April I got to the border at 6:30pm was cleared by both Immigration and Customs but was told that I would have to return to the border the next day because the Public Works officer had already left and I could not continue my trip without pay the toll fee.
When I enquired about this officer's working hours I was told that he left between 4 and 5pm but the border only closes at 10 pm (if memory serves me right).
 
Resolution status note: At the Tripartite NTBs Online Reporting, Monitoring and Eliminating Mechanism Meeting to Launch the SMS Reporting Tool held from 9-10 April 2013 in Lusaka, Zambia, Zambia reported that the differences in the working hours for the different agencies had been brought to their attention and that all border agencies operate at the same operating hours.

Complaint: Truck belonging to BRARUDI (the leading Brewery in the Republic of Burundi) has been held at the border of Burundi/Tanzania for a period of 15 days (Tanzania side )because Tanzania Revenue Authority at the border estimate that the products must pay customs duties before enter Tanzania, despite the consignment being accompanied by a certificate of origin issued by Burundi Revenue Authority. And Tanzania Food and Drugs Authority requires the company TO register the products before exporting.  
Resolution status note: On 23 December 2013, Burundi Focal Point reported that BRARUDI Products made in Burundi were allowed to enter in Tanzania following resolution of this NTB during the 13th NMC regional forum held in Burundi 17-20 December 2013.

Complaint: High way attack that occurred in TANZANIA near NZEGA Town along the Central Corridor  
Resolution status note: At the 16th EAC regional forum on non tariff barriers held in Kigali in December 2014, Tanzania reported that security had improved. Tanzania was providing police escorts. This NTB is therefore resolved.

Complaint: Tanzania are charging railway development levy (RDL) to Kenya products. Tanzania is not adhering to the EAC law where it states clearly that products within the EAC should not be subjected to RDL  
Resolution status note: During the Bilateral meeting that took place in January 2018, the Permanent/ principal Secretaries took note that Tanzania does not levy RDL on products originating in the EAC region. And hence the NTB was Resolved.

Complaint: Distell, a Tape Town based exporting company is experiencing delays and high costs of processing SAD500 entries and SADC certificates for their wine exports to Zimbabwe. The current procedure where the Distell driver cannot take the SAD500 entry and SADC certificate to Customs to have it stamped and signed over the counter is cumbersome and costly for the company. The company has to wait for at least 2 days for either the release notification or the stamped and signed SADC certificates. This leads to the truck waiting at the depot for the documents, which results to either standing time cost at the depot or standing time at the border.
The requirement is as follows: Distell Company loads Bulk orders in Tanktainers and Drums from Monis in Paarl or Adam Tas in Stellenbosch, Cape Town which goes by road to Zimbabwe. Currently export documents can only be done by the Freight forwarder immediately after the Tanktainer or Drums are loaded. Export documentation cannot be processed earlier, as company has to wait for the final weight loaded into the truck. The alternative method to use flow meters and cut off the loading on a specific amount of liters is used because it is does produce accurate measurements.
Actual Current process for Bulk - Tanktainers (Tankerservices transport)
- Truck to be arranged for loading very early on a Tuesday morning @ 07:00am
- Most of the time 2 to 3 truckloads which will load one after the other.
- The following is all also done on the Tuesday:
o The wine is loaded.
o Distell invoices and forward the relevant documentation to Imperial Logistics in Johannesburg.
o Imperial Logistics processes the Customs entry via EDI.
- Once EDI release is received (after at least 2 days), Imperial Logistics sends the Release notification via e-mail.
- Distell advises Tanker Services to collect the relevant documentation and leave for the border.
- Imperial Logistics will have the SADC certificate stamped at the border.
- Tanker services driver to collect the original SADC certificates at the border.
A permanent solution for exporters in Cape Town to provide an over the counter service for our SAD500 & SADC entries is required.
 
Resolution status note: Zimbabwe Focal Point reported that the NTB had been resolved . South Africa was issuing SAD500 on time

Complaint: Two Trucks on Transit from Rwanda to Mombasa carrying minerals for export are impounded by Uganda Mineral Protection Police Unit.  
Resolution status note: Uganda confirmed to have received evidence of this NTB from Rwanda. The Trucks that were being held had no customs issue as they had fulfilled all transit requirements. The Uganda Mineral Protection Police Unit had held the trucks claiming the transit documents were forged however, customs was consulted and proved that the documents were genuine.

The SCTIFI meeting held in November, 2018 was informed that the Ministry of Foreign Affairs – Uganda convened a meeting and resolved that matter.

The matter was resolved.

Complaint: Posting of sufficient personnel to Mutukula One Stop Border Post (OSBP). Tanzania has already deployed staff necessary to meet the 24/7 working hours. But Ugandan border officials does not work 24/7. Thus, business from Tanzania to Uganda is severely affected.  
Resolution status note: During the Sectoral Committee on Trade held on 31 October 2019, the Republic of Uganda reported that the Mutukula OSBP is now fully operational at 24/7 basis. The following number of staff from respective agencies were deployed:
Customs (URA) - 25
Immigration (MIA) - 11
Ministry of Agriculture Animal Industry and Fisheries - 3
All other relevant agencies (MAAIF) are present at the OSBP
Hence the NTB was resolved.

Complaint: Zimbabwean clearing agents are stopped by Zambian security agents from driving across to Zambian side to perform Zimbabwean exit formalities (this is contrary to the OSBP arrangement).
 
Resolution status note: During the border verification mission by Zambia national Monitoring committee held on 11- 12 June 2020, both Zambia and Zimbabwe border agencies reported that they had put in place a temporary measure whereby a list of Zimbabwean clearing agents doing business during the COVID-19 Pandemic was prepared and shared between Zimbabwe and Zambia. NTB was resolved by this temporary measure

Complaint: Pilferage of goods and the opening of sealed containers at the South African side of the Beitbridge border post  
Resolution status note: At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012,South Africa reported that they would consult SARS to provide an explanation of how the border process works and on measures put in place to prevent the incident re-occurring. Once this information was received from SARS, it wiould be uploaded to the online system. It was therefore agreed to have this NTB resolved as this could have been a once off incident.

Resolution status note: At the 16th NTBs forum held in Kigali in December 2014, EAC Secretariat reported that the 15th EAC Forum on NTBs noted that the ongoing construction of OBSP was addressing this NTB and Partner states reported that construction of OSBPs was at advanced stages at key border posts. This NTB is therefore resolved

Complaint: Authorisation fees for endorsement of COMESA Certificate of
Origin

Uganda has complained that Egypt authorities require that Certificates of Origin be endorsed by the Egyptian Embassy in Kampala before dispatch of the goods.
 
Resolution status note: Egypt reported that she does not require consular or Embassy export documentation. A ministerial Decree issued by the Government of Egypt was circulated to all COMESA Member States on March 22 2007.

Complaint: When Zimbabwean goods are exported to DRC via Zambia, Zambian authorities require that a bond guarantee be deposited with Customs authorities to safeguard the goods in transit. Zambian authorities call for the bond guarantee to be paid in hard currency at port of entry but refunds are made in Zambian currency at port of exit. The Zambian currency may be of no use to the exporter in the country of destination of the products or country of origin.  
Resolution status note: Zambia reported that all payments to Zambia Revenue Authority (ZRA) are in Zambian currency (Kwacha). Based on existing legislation which is consistent with international best practices, all goods transiting through Zambia are expected to be on a transit document (and covered by transit bond/security) or a monetary deposit on all those without bond cover. With the newly introduced Electronic Deposit account system in place, clients who pay a deposit at Entry point are able to get the refund at the Exit point provided they comply with deposit conditions.
