47. ( 1) All premises where medicines or medicated feeds are stored, used, handled, dispensed, manufactured or sold, and any vehicle, transshipment, or receptacle in which medicines are transported, shall be subject to inspection with or without prior arrangement with the person in control of the premises, vehicle, transshipment or receptacle by an inspector authorised by the Authority, in writing, and such inspector shall be given unhindered access to such premises with the right to take samples of any medicines on the premises, without payment, and to carry out any investigation that the inspector considers necessary.

12(1) No person shall export from Botswana any hides or skins unless-
(b) the hides or skins are trimmed in accordance with the provisions of paragraph 6 of the First Schedule;

Every completely dried hide or skin shall be trimmed prior to export, by the removal of any portions
which covered the head, the shanks below the knee and hock joints and that part of the tail which is more
than 0,2032 metre from the junction of the tail with the hide or skin.]
(c) the bales are clearly labelled with distinctive marks (commonly known as "shipper marks"), registered with the Director of Veterinary Services;
(d) the hides or skins are branded in a manner approved by the Director of Veterinary Services;
(e) any tax in respect thereof payable under any law for the time being in force in Botswana has been paid;
(f) such hides or skins are graded and correctly classified either as ground dried, suspension dried, dry salted or wet salted, and are prepared and protected against insect damage, completely dried (unless they be wet salted hides or skins), and otherwise in a fit condition for export.
15. Transportation
(1) No person licensed under these Regulations shall move or transport any hide or skin from any premises within Botswana to any other premises or place without the written permission of a veterinary officer.
(2) Every person licensed under these Regulations who moves or transports hides and skins shall take all necessary precautions to prevent such hides and skins from being damaged during transit and to prevent any cutting, tearing, cracking or staining of such hides and skins during the process of baling or thereafter and, in the case of completely dried hides and skins-
(a) provide adequate covering against rain;
(b) tie hides or skins into firm bundles;
(c) stack such bundles in the transport vehicles in such a manner as will prevent damage caused by rubbing, and provide reasonable protection against dust.
(3) Any person who contravenes the provisions of subregulation (1) or (2) shall be guilty of an offence and liable on conviction to the penalties prescribed in regulation 6

19. Search of vehicles
Any veterinary officer, administrative officer or police officer of the rank of sub-inspector or above, may stop and examine any vehicle carrying, or suspected by him to be carrying, hides or skins, excluding green hides or skins, possessing any of the defects described in regulation
12, and may inspect any hides or skins found in such vehicle or in the possession of such person, or he may direct the person in charge of such vehicle to convey the hides and skins to some suitable place where they may be inspected by a veterinary officer, or may carry away and detain such hides or skins for the purpose of instituting proceedings under these Regulations.

21. Qualifications of export processing zone developers and operators
(1) An export processing zone developer or operator shall—
(a) be a company incorporated in Kenya for the sole purpose of developing and operating an export processing zone;
(b) have the necessary capital and expertise required for developing the export processing zone; and
(c) except for an export processing zone operator appointed under section 22, own or lease land for a minimum period of thirty years within the export processing zone.
(2) Each export processing zone developer shall receive an export process zone operator’s licence from the Authority if it qualifies under the criteria prescribed in the regulations.

10. Conditions for an exporter’s or importer’s licence
In addition to any conditions which may be prescribed under this Act, every
exporter or importer shall—
(a)equip and maintain his premises to the satisfaction of the Director;
(b)carry out the grading of the hides, skins and leather to the satisfaction
of the Director; and
(c)keep proper books in English or Kiswahili in the manner prescribed

Description of the measure
4. Import, export, etc., of pest control products
(1) No person shall import into, or sell in, Kenya any pest control product unless that product has been registered, packaged and labelled in accordance with regulations made under this Act and conforms to the standards specified in those regulations.
(2) No person shall export or re-export out of Kenya any pest control products unless he has complied with the requirement specified in regulations made under this Act.

Description of the measure
(5) A person exporting a genetic resource shall be required to declare the resource at the port of departure and produce a copy of the Material Transfer Agreement.
16 (1) Rough diamonds shall be exported or imported in containers in accordance with this regulations.
(2) A container for the export or import of rough diamonds shall be constructed in a manner that makes the reseal of the container impossible after it is opened.
(3) The container in which rough diamonds are exported shall bear the serial number of the accompanying Kimberley Certificate.

The Regulations made under the Pests Control Products Act relating to the classification, registration, labeling, packaging, advertising, import, export, distribution, storage, transportation, handling and disposal of pesticides shall apply to this Part.
16. Board to issue licences for export, import, manufacture, etc.
(1) The Minister shall establish a Board which shall consist of—
(a)the Attorney-General or his representative;
(b)the Permanent Secretary of the Ministry for the time being
responsible for Provincial Administration and/or Internal Security or his representative;
(c)the Permanent Secretary of the Ministry for the time being responsible
for Health or his representative;
(d)the Commissioner of Police or his representative;
(e)three other persons appointed by the Minister of whom one shall be appointed as the chairman.
(2) The Board shall—
(a)issue licences for the importation, exportation, diversion, sale, manufacture, production or distribution (at stated places) of any narcotic drug of psychotropic substance;
(b)name ports or places in Kenya where any narcotic drug or psychotropic substance may be exported or imported;
(c)prescribe the manner in which any narcotic drug or psychotropic substance is to be packed or marked for export; and
14. Power to make rules
The Minister, on the advice of the Board, may make rules for any of the following
purposes—
(h) prescribing the conditions to be fulfilled in respect of grading,
conditioning, baling, packing and marking sisal fibre for export;
(i) providing for the inspection, weighing and measuring of sisal fibre for
export and for anything to be prescribed under this Part;

Description of the measure
(3) The Authority may at its discretion order the exclusion or removal from an export processing zone of any goods or discontinuance of any activity or operations which in its opinion, are dangerous or prejudicial to public interest, health or safety:Provided that the Authority shall not issue an order under this section without first giving such a person an opportunity of being heard.
(4) Any person who contravenes this section shall be guilty of an offence and liable to a fine not exceeding two hundred thousand shillings or to imprisonment for a term not exceeding three years or to both.
17. Activities permitted within an export processing zone
(1) The activities eligible to be carried out within an export processing zone shall be manufacturing activities, commercial activities or service activities:
Provided that—
(i)where manufacturing and commercial activities involving goods manufactured outside Kenya are carried on by an export processing zone enterprise, the two activities shall be physically separated; and
(ii) where commercial activities involve goods manufactured outside Kenya, such goods shall be clearly labelled as products of the country where such goods were manufactured.
(2) For the purposes of subsection (1), notwithstanding the repeal of the First Schedule the activities specified in that Schedule or additions made thereto by the Minster by notice in the Gazette shall continue to be carried out in the manner specified for each designated export processing zone.

16. Packaging
(1) No person shall import, export, manufacture, sell or distribute any dangerous chemical unless it is packaged in accordance with requirements set out in the Tenth Schedule.
18. Duty of importer, exporter or manufacturer
(1) Any person who imports, exports, manufactures, sells, distributes or otherwise handles, in the course of a business activity, a dangerous chemical shall ensure that
(a) the dangerous chemical marketed in any form or quantity is provided with a safety data sheet free of charge when delivered to a user;
(b) the information on the safety data sheet is compiled in accordance with the Eleventh Schedule.
(2) Every importer, exporter or manufacturer of a dangerous chemical shall, when the dangerous chemical is imported, exported or manufactured, as the case may be, for the first time, forward to the Board a copy of the safety data sheet.
25. Storage
(1) No person shall store or handle a dangerous chemical except in accordance with the Sixteenth Schedule.
(2) No person shall store any extremely dangerous chemical without an authorisation issued by the appropriate enforcing agency.
To eliminate an entire category of weapons of mass destruction by prohibiting the development, production, acquisition, stockpiling, retention, transfer or use of chemical weapons.

4 Entries for excisable goods
(1) Every manufacturer shall, in relation to excisable goods other than molasses and sugar cane juice submit an entry to the Director-General at the time –
(a) the goods are deposited in an excise warehouse pending removal for home consumption, for export or for export as ship’s stores; and
(b) the goods are removed from a factory.
(2) No excisable goods referred to in subsection (1) shall be deposited in or removed from a factory unless –
(a) the entry has been validated at Customs; and

(i) the number of bottles it contains;
(ii) the total contents of matured rum or matured local rum in litres; and
(iii) the name of the owner of the matured rum or matured local rum.
