Complaint:	South Africa trucks with Zimbabwean and Zambian drivers are being impounded and at times foreign drivers get fined by the South African Cross Border Transport Agency for not possessing South African Professional Driving Permits disregarding section 32(3) of the National Road Traffic Act (Act No. 93 of 1996) which stipulates that "any document , serving a purpose similar to that of a professional driving permit issued by a competent authority , be deemed to be a professional driving permit". This has been a serious issue for many years and rears its head every now and then. (
Resolution status note:	South Africa reported that Zimbabwean driving a Zimbabwean registered vehicle only need to produce a credit card metal licence with a category for the Public drivers for heavy vehicles marked '2', endorsement of medical certificate and expiry date at the back of the licence. Drivers driving a vehicle not registered in Zimbabwe should produce an A5 size white booklet type licence, International driving permit equivalent of a Proffessional Driving Permit in South Africa issued by Automobile association of Zimbabwe. An AA stamp indicating category for heavy vehicle will be displayed on the right handside of the document. Zambian public drivers licences are similar to those of South Africa issued with a C1 to EC category of licences with endorsement (PrDP) .However the Zambian driving licences have 'P', which means passengers and 'G' indicating goods and th expiry date next to these categories

Complaint:	SARS is issuing a blue colour SADC certificate of origin with wrong specifications instead of the approved Yellow certificate which is in accordance to the SADC specifications. Zambia Revenue Authority has rejected the blue certificates and demanded that Zambian importers pay full duties as deposits in order to clear their cargo which would have qualified under the SADC rules of origin had a proper certificate been issued.

Resolution status note:	During the 8th meeting of the SADC Sub Committee on Trade Facilitation ,Mozambique reported that the US$150 is a scanning charge gazette and information available to port users. Security is not assigned arbitrarily.

Complaint:	Tanzania was charging a discriminatory US$100.00 for visa for all business people attending the Saba Saba Trade Fair in Dar es Salaam without notification.
Resolution status note:	Tanzania reported that there is no VISA between Tanzania and Zambia. US$ 100 is not VISA but rather a Temporary Assignment Pass for any gainful activity which is undertaken for less than 3 months which is being paid at the entry and exit points respectively. Notification is communicated during the preparations of the trade fairs.

Complaint:	Dar es Salaam port arbitrarily transfers containers to Inland Container Deports without the knowledge of importers and charges importers between US$150-US$200 depending on the type of ICD the containers are sent to.
Resolution status note:	Tanzania reported that, currently the TPA is discouraging the Transit Cargo to be transferred to ICDs by keeping them at the port or by operating the system of Whole Ship Transfer to ICDs with no additional charges.

Complaint:	The Office dealing with export permits for seed in the Ministry of Agriculture in Zambia only opens at 11.00 hours. This causes delay in obtaining the export permits.
Resolution status note:	Zambia reported that the office opens from 08:00am to 5pm, but collection starts at 11:00am to allow for processing in the morning.

Complaint:	Zambia Revenue Authority delays clearing goods at Victoria Falls Border Post in Livingstone, it takes the whole day or two for travellers to be cleared. Only one officer is assigned to inspect the goods and there is arbitrary valuation of goods by the customs officer
Resolution status note:	Zambia reported that it only takes 20 minutes to clear passengers with no goods and upto 3hours for those with goods. There are two officers who inspect as the passenger traffic has reduced due to a number of them opting to use the Chirundu OSBP. For valuation of goods, they use an already existing database.

Complaint:	Asycuda++ system closes at 16.00 hrs for new entries . ZRA does not continue to clear goods after 16.00hrs.
Resolution status note:	Zambia reported that the Asycuda++ system is 24hours for those on DTI and there is also e-payment. Its only those who are not on DTI and access the system through Necor which closes at 16hrs are affected, otherwise the system does not close.

Resolution status note:	At the 9th meeting of the SADC Sub-committee on trade facilitation, Zimbabwe reported that the current charge of US$10 on issuance of SPS certificates is competitive in the region. There are no harmonized charges for SPS certificates in the SADC region.

Complaint:	Documentations requirements for exports to Kenya are too cumbersome (SGS invoice is issued after one month and you are charged inspection charges. With regards to import permits, Zambian exporter has to raise COMESA Certification and send to Kenyan importer before shipping the goods. This process takes more than 3 months.

Resolution status note:	South Africa reported that importation of red meat from Zambia to SA was never allowed because Zambia did not send SA the information she needed to evaluate their animal disease situation, legislation, standards and other requirements. The information was requested in 2006 in the form of a questionnaire by the Department of Agriculture - Directorate Animal Health, Zambia has never responded.

Resolution status note:	South Africa reported that SADC is in the process of implementing the TBT annex and establishing the necessary regional institutions to create a regional accreditation system. Until the structures are developed and operational, South Africa will continue to request that products which are not accredited by recognized international accreditation bodies be retested by the South African Bureau of Standards (SABS). This exercise is not meant to deny SA trading counterpart’s access to the South African market, but simply to protect South African consumers.
