Complaint:	Restrictions of exports on account of standards and provision of user instructions in specified local languages.Restriction of coffee exports and exports of paste detergents to South Africa and Zimbabwe
Resolution status note:	South Africa reported that SADC is in the process of implementing the TBT annex and establishing the necessary regional institutions to create a regional accreditation system. Until the structures are developed and operational, South Africa will continue to request that products which are not accredited by recognized international accreditation bodies be retested by the South African Bureau of Standards (SABS). This exercise is not meant to deny SA trading counterpart’s access to the South African market, but simply to protect South African consumers.

Complaint:	Restriction on importation of tobacco leaf from SADC countries
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012, Malawi submitted that importation of tobacco was not restricted. As a matter of fact Malawi imports tobacco from Tanzania Zambia for processing at Malawi companies. The tobacco is re-exported after processing. The meeting was also informed that the companies buying tobacco in the region are the same.

Complaint:	Requirement to foreign exhibitors in Kenya to have a trading license to be able to display their products in the trade fair without which a fine of Ksh 1,000 per day is imposed to the exhibitor by the City Council. The incident occurred during the Nairobi International Trade Fair that took place at Jamhuri Park to 30th September to 6th October 2019
Resolution status note:	During the Sectoral Committee on Trade Kenya reported that it was a one off issue and is committed that it will not happen again in other upcoming exhibitions. The meeting agreed that exhibitors should be informed not to accept any charges and should report to the relevant authorities in case it happens. Hence it was resolved.

Complaint:	Requirement that transporters using the road network should use the Ethiopian transporters. Kenya has complained that Ethiopian authorities require that all transporters must use Ethiopian transporters.

Complaint:	Requirement that goods exported to Ethiopia should be transported through the National Shipping Lines. Kenya has complained that Ethiopian authorities require that all exporters to Ethiopia must use national shipping lines.
Resolution status note:	Ethiopian Government wrote to COMESA Secretariat on 7th January 2008 stating that they were now complying with Article 57 of the Treaty

Complaint:	Requirement by United Republic of Tanzania to transit trucks carrying chemicals to have export and transport chemical permits. Trucks are charged US$ 1 per ton and in most cases arbitrary charges which are imposed to transit vehicles only. The amount is applied to the entire container weight regardless of the weight of the other non-chemical products being transported in the container. Permits are difficult to obtain during week-ends and original copies are required at the border creating further delays
Resolution status note:	The RMC meeting held on 1 September 2020 agreed that this complaint be resolved as it is agreeable by Law and hence is not an NTB

Complaint:	Requirement by Tanzania Revenue Authority to Rwandan transporters to use two customs bonds on the Northern-Central Corridor (Kigali-Rusumo-Mombasa via Holili-Taveta border post) costing US$ 150 on departure and US$ 80 on return
Resolution status note:	During the SCTIFI the Republic of Rwanda noted that the the regional bond will be concluded by 1st July, 2021; in the interim traders are incurring double costs and hence urged the United Republic of Tanzania to waive the requirement of the Regional bond while awaiting the finalisation of the Same. On the issue of waiving the requirement of the Regional bond, Tanzania reported that the Commissioners of Customs will advise during their engagement.The SCTIFI agreed that the issue is operational and should be referred to the Committee on Customs for resolution. Hence it is resolved in this EAC Time Bound Programme

Resolution status note:	During the meeting of the NTBs Focal Points held from 19- 21 august 2019 , Tanzania reported that TFDA was disbanded therefore the requirements are no longer enforced .

Complaint:	Requirement by KRA for transporters to have introductory letters from URA on certain products / consignments, e.g. tyres and spirits.
Resolution status note:	On 5 December 2013, Kenya focal point reported that this NTB had been resolved. Kenya Revenue Authority issued a notice to all Transporters , shipping agents, clearing and forwarding agents on the electronic cargo tracking systems as the principal systems for monitoring the movement of cargo under customs territory and all stakeholders were expected to comply by 31st January 2014 . The Vehicles that are fitted with Electronic Cargo Tracking Systems WOULD: 1. Get waiver of TGL fees 2. Be able to carry goods on transfer to other partner states and within Kenya subject to approval 3. Enjoy the priority loading at the all customs areas and 4. Move without customs escort through the Northern corridor. Transporters and shipping lines and agents are now allowed to carry goods along the corridor without challenges previously affecting them.

Complaint:	Registration and accreditation of transporters is too high, (Charge is USD 10,000 per company so that only capable and serious transporters are registered)
Resolution status note:	Tanzania Revenue Authority reported that TRA is responsible for issuing the transporter license and that the fees is only Ks 20 000.
