Complaint:	Delays by Partner States to harmonize SPS protocol has resulted in cut-flower from Tanzania for re-exports to Europe and Russia blocked by Kenya.
Resolution status note:	At the 16th EAC regional forum on non tariff barriers held in Kigali in December 2014, Kenya reported that the blockage had been lifted. This NTB is therefore resolved.

Complaint:	Lack of recognition of CTH criteria in the EAC Rules of Origin for motor vehicles by Tanzania, Uganda and Rwanda
Resolution status note:	At the 16th NTBs forum held in Kigali in December 2014, EAC Secretariat reported that Partner States are now recognizing EAC rules of origin. This NTB is therefore resolved.

Complaint:	Kenyan Trucks entering into Tanzania are charged a levy of US$ 200 each
Resolution status note:	At the Tripartite NTBs Online Reporting, Monitoring and Eliminating Mechanism Meeting to Launch the SMS Reporting Tool held from 9-10 April 2013 in Lusaka, Zambia, Tanzania reported that the $200 Charged on all Tracks entering Tanzania had been abolished abolished effectively from June 2012 and instructions had been sent to all posts to stop charging this levy.

Complaint:	Kenyan Trucks entering into Tanzania are charged a levy of US$ 200 each
Resolution status note:	At the 12th Regional Forum on NTBs held from 14th – 17th, October 2013, at EAC Headquarters, Arusha, Tanzania, and United Republic of Tanzania reported that the USD 200 levy on Kenya trucks was abolished in June, 2012.

Resolution status note:	On 21 may 2012, Tanzania reporterd that, the Simplified Certificates of Origin had been posted to all TRA regional managers, district managers and officer in charge of all border stations as at Friday 18th May, 2012.

Complaint:	Cigarettes manufactured in Kenya exported to Tanzania required to have a local 75% tobacco content.
Resolution status note:	During the EAC Dedicated meeting on Non tariff Barriers held in Mombasa on 14th March 2012, Tanzania reported that the requirement for 75% local content for BAT cigarrets had been abolished and therefore the NTB is resolved.

Complaint:	Kenya tourist vans are not allowed to enter Tanzania. They are required to off load tourists to Tanzania registered vans.
Resolution status note:	On 1 June 2012, Tanzania reported that, Tourist vans from Kenya are allowed to enter into Tanzania as foreign vans provided they have C32 formerly known as C36. A van carrying below 9 passengers are allowed free for 7 days. Van with 10 and above passengers are categorized as commercial vans and required as per Transit Act, 1995 to pay US$ 16 per axles in every 100 kms. Tanzania advises Partner states to adhere to requirements for entry into another Partner State to avoid delays and inconveniences. Tourist vans should make sure they check all requirements and have fulfilled them before they set off for Tanzania.

Complaint:	The simplified trade regime to enhance cross border trade is not implemented since the simplified certificate of origin is not used. For the certificate of origin to be accepted, each country has to provide a list of products that regularly cross the border. Rwanda Revenue Authority on 16th September 2011, send a request to Tanzania asking for the list of common traded goods at our borders but did not receive a response.
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012,Tanzania reported that it launched the simplified trade regime at Rusumo border in March 2012. Tanzania has inaugurated and exchanged the list with Rwanda and the rate is no longer US$500 but US$2000 as from 16 March, 2012

Complaint:	SteelRwa was denied to import scrap metals from Tanzania due to the ban resulting from its scarcity in the region. Tanzania, Kenya and Uganda have banned exports of scrap metals not only to non EAC members but also the ban is applicable to other EAC member states
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012,Tanzania reported that it had ratified the Bamako convention that governs the movement of hazardous wastes with in Africa. Tanzania has neither banned importation nor exportation of scrap metals, but there are procedures to follow when engaging in such business: i) A team of experts has to inspect the scrap metals to ensure that the consignment is safe to and allowed to be exported. ii) The exporter has to obtain an export permit from the MIT. There are scrap metals that are not allowed to be exported from Tanzania. The list is supported by a Legal instrument. (The Exports Control Act Cap. 381, Prohibition of Exports, Amendment of the Schedule) Government Notice No. 204 published on 22/7/2005, Section 16). This applies to all countries not Rwanda specifically. Rwanda is withdrawing this NTB from the matrix due to lack of evidence from complainant.

Complaint:	Lengthy procedures for issuing work permits by Kenya, Uganda and Tanzania Immigration departments.As per BCI 2008 ,business take between 1-5 months to acquire work permits for workers sourced from another EAC country.Businesses are forced to employ locals who may lack required skills.

Complaint:	No movements of Cargo Trucks beyond 6:00 pm within Tanzania. This affects trucks from Rwanda, Burundi & Uganda
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012, Burundi agreed that this NTB be resolved on the basis that Tanzania was modernising the tracking equipment so as to have electronic devices that can be monitored electronically along the transport corridor to the final destination. This provision allows Tanzania Revenue Authprity to make the necessary timely interventions. Burundi and Tanzania have signed a joint MoU in joint patrol and were provided equipment to maintain security along the affected areas. However Tanzania wouldl notify Burundi on the operationalization of the Electronic Cargo Tracking System (ECTS).

Complaint:	EXPORT OF PLASTIC FROM KENYA TO TANZANIA ARE SUBJECTED TO 25% DUTY
Resolution status note:	At the 12th Regional Forum on NTBs held from 14th – 17th, October 2013, at EAC Headquarters, Arusha, Tanzania, the EAC secretariat reported that a report of the verification mission was considered by the meeting of SCTIFI following which , letters were sent out to Partner States and revenue authorities informing them that plastic products are supposed to benefit from preferential treatment.

Complaint:	Police officers at the Kirumu check point are harrassing Truckers bringing goods to Tanzania through Sirari border post. The harrassment is associated with attempts to solicit for bribes. Truck owners claimthat although they usually have all the customs receipts pertaining to the merchandise they are carrying, police officers have continued to hassle them for no apparent reasons.
Resolution status note:	At the NMC meeting held in Nairobi on 29 August 2011, Kenya reported a necessary disciplinary action had been taken to address this problem.

Resolution status note:	At the Tripartite NTBs Online Reporting, Monitoring and Eliminating Mechanism Meeting to Launch the SMS Reporting Tool held from 9-10 April 2013 in Lusaka, Zambia, Tanzania reported that a verification mission to authenticate whether the products conform to the Rules of Origin was undertaken and the NTB had been resolved.

Resolution status note:	Tanzania reported that documentation procedures have been decentralized as a result of use of online lodging of documents and extended working hours at the custom's department, among other improvements. Tanzania Revenue Authority reported that all documentation for imports is available processed online. All exports documents are processed at the border.

Complaint:	Tanzania was charging a discriminatory US$100.00 for visa for all business people attending the Saba Saba Trade Fair in Dar es Salaam without notification.
Resolution status note:	Tanzania reported that there is no VISA between Tanzania and Zambia. US$ 100 is not VISA but rather a Temporary Assignment Pass for any gainful activity which is undertaken for less than 3 months which is being paid at the entry and exit points respectively. Notification is communicated during the preparations of the trade fairs.
