Complaint: Madagascar does not confer originating status to Citron Plus soap manufactured by Mauritius and exported to Madagascar  
Resolution status note: During the 27th COMESA TC Committee in August 2011, the COMESA Secretariat was directed to liaise with Madagascar to implement the Council decision taken at its 29th Meeting in Lusaka to provide justification for refusing the COMESA Certificate. Currently, Mopirove is exporting without difficulty . However an official decision is yet to be communicated to mauritius to avoid the risk that Madagascar Customs can refuse the COMESA Certificate of Origin from Mauritius

Complaint: Madagascar does not confer originating status to Citron Plus soap manufactured by Mauritius and exported to Madagascar  
Resolution status note: The two parties agreed that the issue does not constitute an NTB because the soap exported by Mauritius to Madagascar enters duty free therefore its not a NTB. This matter is therefore resolved . Madagascar requested the Secretariat to organise . Mauritius confirmed that Exports are no longer subjects to verification on RoO.

Complaint: Long lead time to confirm paid taxes; for exports into Tanzania once entries have been lodged and taxes paid, it takes 1 week for Tanzania Revenue Authority to confirm that taxes have been paid. The process of confirmation is supposed to take 1 day.  
Resolution status note: The 25th EAC NTBs Forum held from 9-12 May 2018,was informed that this matter had been resolved by the bilateral meeting between URT and Kenya.

Complaint: Logistical bottlenecks along the Nacala and Beira rail routes have resulted in nearly 60% of Malawi's tobacco exports being sent overland to the more distant port of Durban.Nacala and Beira routes relatively expensive and inefficient.

Complaint: Lesotho is imposing requires permits on the imports of following bread, milk, eggs, bulk sugar imports, pulses, fruits and vegetables, livestock and liquor.  
Resolution status note: Lesotho reported that she does require permits on the importation of some agricultural products. The Agricultural Marketing Act 26 of 1967 (amended by Act NO.18 of 1973, Order No.6 of 1991 and Act No.5 0f 2001) regulates the importation and exportation of the agricultural products in Lesotho.
The purpose of this Act is to prohibit the importation of products and supplies which are unsafe or inappropriate for the function for which they are to be sold.

Resolution status note: The meeting establishing Lesotho NMC held on 09 August 2011 in Maseru resolved that Lesotho's imposition of this requirement is accordance to article 9 (e) of the SADC Protocolon trade and therefore not an NTB. It was also observed that reporting country had not objected to Lesotho explanation submitted to the 9th meeting of the SADCSub Comitttee on Trade facilitation held in Gaborone on 27 July 2011. This matter is therefore considered resolved.

Complaint: Lengthy procedures for issuing work permits by Kenya, Uganda and Tanzania Immigration departments.As per BCI 2008 ,business take between 1-5 months to acquire work permits for workers sourced from another EAC country.Businesses are forced to employ locals who may lack required skills.  
Resolution status note: At the 16th EAC regional forum on non tariff barriers held in Kigali in December 2014, EAC Secretariat reported that the Kenya had abolished this requirement. This NTB is therefore resolved

Complaint: Lengthy documentation in TRA thus delays and demurrage costs
It takes not more than 3 days to get all necessary documents for Kenya, Rwanda and Uganda while it can take upto 10 days(or more) for TZ since all documentation is processed though the exit border before truck leaves Kenyan side

TRANSPORT PERMIT
There is no requirement for transport permit for KE, UG & RW.
There is need for customs to harmonize and reduce documentations so as to simplify export processes and facilitate trade.
 
Resolution status note: Tanzania reported that
a) Transport permits for chemicals related products are issued once the import permit has been issued.
b) For the case of this evidence provided by Kenya, the import permit no.964556 was issued to Kiboko Precoated sheer on 21st of August, 2019 and on the same date 21st of August, 2019, a transport permit 174391 was issued to transport the said chemicals (Charan sign& Sons campany) and therefore there were no delays in issuing the transport permit as it was issued on the same day. It should be noted that the company imports those chemicals is the Tanzania company and transporter of those chemicals was Kenyan Company.
c) United Republic of Tanzania is requesting all exporters to seek all necessary document required before arrival at the Border Post to avoid any delayed and register on the online portal
d) Currently Tanzania do provide chemical and transport permits from Monday to Saturday using the online portal. In addition to that, we have chemical inspectors at all border points operating 24/7
