The Zimbabwe road traffic authorities are enforcing vehicle equipment regulations that pertain only to their own country and are not harmonized with other countries.
An example of this is for a truck to display its tare and gross mass on the exterior of the vehicle, in numbers and letters of a particular size. This requirement is not the same as for other countries. The Zimbabwe authorities should accept the certificates of roadworthiness from other countries. Zimbabwe should not harass drivers for such issues. |

On 13 September 2013, FESARTA reported that they had subsequently received a letter from the Ministry of Transport, Communications and Infrastructural Development, directed to the Zimbabwe Republic Police, instructing the police to accept the standards of South African vehicles. FESARTA believes that this letter will also indirectly apply to vehicles from countries other than South Africa entering Zimbabwe. Therefore, FESARTA recommends that NTBs 524 and 563 be considered resolved. |

The Zambian Ministry of Agriculture has cancelled all export permits and required exporters to apply for an individual permit for each truck. No notice was given.
This has resulted in significant delays in that trucks en route have to wait at the border whilst new permits are applied for.
In addition, permits are only being issued for up to 30 tons.
56-ton gross combination mass vehicle combinations can load 33 tons and over, meaning a reduction of at least 10% of the load.
There is no legal justification for restricting the load to 30 tons, since the road traffic regulations control loads through axle loads, gvm and gcm. Never the load on the vehicle.
This will result in an increase in cost to transport the goods. |

The unstable situation at the Kasumbalesa border post between Zambia and the DRC, is causing serious delays on the North-South corridor.
Over the past 6 months, lawlessness on the DRC side of the border, is leading to drivers foreign to DRC being harassed and, on some occasions, being attacked. Police have been unnecessarily harassing drivers for speeding, unroadworthy vehicles and incorrect documentation. The lack of security has resulted in two drivers being shot and wounded; the latest being Patrick Murifi, 31, a Zimbabwean truck driver.
This has caused drivers preparing to enter DRC from the South, to become agitated and, on two occasions, go on strike and effectively close the border to heavy vehicle traffic.
Copperbelt Police chief Joyce Kasosa has confirmed in an interview recently, that calm has been restored but trucks are still not crossing into and from DRC because the drivers want to be addressed and assured of their security while in that country.
It is clear that the situation is volatile and likely to erupt into violence at any time, for the slightest reason.
This situation is not conducive to intra-regional trade and unacceptable to the road transport industry.
A deputation from DRC yesterday to the drivers on the Zambian side, has convinced the drivers to start moving again.
However, the drivers have warned that if there should be further occurrences of the problem, they will blockade the border for 3 weeks.
SADC and COMESA are requested to intervene and call on the government of the Katanga province to take control of the situation and provide a stable environment conducive to intra-regional trade. |

the traffic police and other authorities in DRC, are enforcing a 40km/hr speed limit on all roads.
If the speed is exceeded, a spot fine of US$500 is imposed.
If the truck is impounded, a further US$100 per day is charged for parking.
This is an unacceptable acitivity, since the normal speed limits are clearly marked with road signs.
40km/hr throughout the country is not a realistic speed limit. |

On 02 December 2012, the Department of Transport in the DRC advised that an agreement between the drivers and the DRC government was reached that , until 30 January 2013, there will be no speed limits imposed. The DRC government will look at the drivers behaviour and will come back with a final solution to this issue after 30 January 2013. |

The traffic authorities at Dondo, near Beira, are harassing foreign drivers over the documents that the drivers carry.
Of particular note is the vehicle registration document for South African vehicles.
The registration document (RC1) shows the vehicle register number, but not the licence plate number. The authorities want the licence plate number to be shown on the document, and are issuing fines for it not being shown.
The South African licence receipt document (LCO) shows both the register number and the licence plate number. This links the vehicle to the registration document. But the traffic authorities do not accept this.
Another driver, this time from Zimbabwe, received a fine because of alterations to the vehicle registration book. The alterations had been done by the Zimbabwe authorities and stamped by them. But this was not acceptable to the Mozambique authorities and a fine was issued.
It has become clear that the authorities at Dondo generally harass foreign drivers.
This does not encourage good relations between countries and does not facilitate intraregional trade.
The Dondo traffic authorities must be trained in trade facilitation matters and not harass drivers unnecessarily. |

The South African Cross-Border Road Transport Agency is wanting to fine trucks for not having road transport permits for the complete trip from Durban to the DRC.
In terms of the bi-lateral transport agreement between Zimbabwe and South Africa, Zimbabwe had issued a permit to a transporter for the Durban-Zimbabwe leg of the trip.
Zimbabwe could not issue a bi-lateral permit all the way to DRC because there is no bi-lateral transport agreement between Zimbabwe and DRC.
Both Zimbabwe and DRC are members of COMESA and therefore Zimbabwe was able to issue a COMESA PTA Carriers Licence to the transporter, to operate between Zimbabwe and the DRC.
Thus, effectively, the transporter had permits to cover the complete trip from Durban to DRC.
The fact that neither the CBRTA nor Zimbabwe could issue a single permit for the full trip, was not the fault of the transporter.
The CBRTA should be facilitating trade between the three countries and not be trying to find any opportunity to fine transporters. |

The South African Cross-Border Road Transport Agency (CBRTA) is fining transporters for transporting goods from Gauteng to Durban without a cross-border permit. The fine is R2000 (USD200) per truck.
The goods are being transported from Botswana and offloaded in a warehouse in Gauteng, South Africa.
The goods are then re-loaded on to different vehicles and transported to Durban.
The vehicles transporting the goods from Botswana, have cross-border permits.
There should be no reason for vehicles transporting goods from Gauteng to Durban to have cross-border permits, even though the goods come from Botswana. The transportation is wholly within South Africa and on South African vehicles.

The old bridge at Beitbridge cannot be opened to traffic because of an existing agreement between the government of Zimbabwe and a private sector company.
It is accepted that it is an old bridge and that it may not be safe for many heavy trucks using it at one time. However, there is a railway line over it and there does not seem to be any refusal to allow trains to use it.
It could be used by private motorists, so freeing the new bridge for heavy goods.
There seems to be no justification to renew the existing agreement. |

The Matola Council, near Maputo, is requiring transporters to purchase a permit to enter its area.
The permit costs in the region of US$80 per trip.
It is not acceptable for a municipality to charge transporters to enter its area.
Transporters pay road user charges for the wear and tear they cause to the roads.
Furthermore, they purchase services and goods from the area and so increase trade. |

Mozambique reported that road user charges were charged at national level and not by Municipalities and that such charges are not legal. Mozambique requested FESRATA to provide proof of payment on the said charges as this is not legal in Mozambique. Proof of payment is provided in the online system. It was therefore agreed that this NTB be resolved and that FESRATA should report any such further charges to Mozambique authorities. |

The managing director of Cross Country Containers in Zimbabwe, has reported that there had been four incidences of hijacking his vehicles in the Gauteng area.
The first was in October 2011, the second in June 2012, the third in September 2012 and the fourth in October 2012.
All the vehicles hijacked, were carrying copper, from the copper mines in Zambia.
A meeting was held between the road transport industry and the SAPS Hawks, in Pretoria, on the 24th October 2012.
A report of the meeting is attached.
These hijackings have had such a negative impact on Cross Country Containers, that it has stopped operating into South Africa.
The road transport industry, under the guidance of FESARTA, is to send a proposal on the way forward, to the Hawks. |

The Kenya National Highways Authority (KENHA) is enforcing the axle load limits, rather than the GCM limit for the vehicle combination.
This is seriously compromising the ability of the transporters in Kenya to operated effectively and the Kenya Transporters Association (KTA) has taken the matter to court.
Some comments by the KTA:
1. KENHA is implementing this axle load rule on an axle by axle case rather than group axles. We realize the official position is group axle because when our enraged members stormed the Mariakani weighbridge yesterday, they promptly switched to weighing on group axles and giving a 5% tolerance, a matter that had hitherto not happened.
2. Their axle weights are 8-16-24 rather than 8-18-24 as the case is said to be in Tanzania. To comply here means one can’t optimize on his load.
3. The Traffic Act in Kenya requires an offender in this case is taken to court, fined and then made to redistribute cargo so that each axle is in conformity before the truck can proceed. The complication arises when the cargo is containerized transit goods which cant be opened sice continer is sealed and opening is criminal!
4. Similar complications arise in the case of liquid cargo which moves rapidly even when truck is being weighed or “sandy” like cargo such as clinker and the like which shifts depending on road terrain/condition or upon braking.
5. Our members are now forced to load 22 to 24 tons of the above cargo instead of the normal 27 tons. Unfortunately the overheads do not come down at all and they are now left with no option but to raise their rates by a similar margin. The question is whether our corridor and hinterland can afford such excessive costs.
FESARTA has drawn up a proposal to solve the problem and it is attached to this complaint. |

The Botswana traffic authorities at Pioneer Gate, are applying outdated overall vehicle width and overall vehicle height limits. The are applying maximum 2.5m width and 4.1m height.
For many years, SADC has recommended 2.6m width and 4.3m height.
Most of the countries in the Southern African region, have 2.6m and 4.3m, and so the vehicles are built to suit these dimensions. They cannot be reduced to 2.5m and 4.3m without major structural alterations.
Furthermore, the 2.6m width was set so that an ISO shipping container, which is 2.4m wide, can be loaded onto a trailer that has sideboards. This cannot be done on a trailer that is 2.5m wide, since the sideboards take up at least 100mm width. The 2.6m also allows two standard pallets to be loaded side-by-side inside a pantechnicon body.
On occasions, when this problem has arisen in the past, the traffic officials have agreed that, to facilitate trade, the vehicles can operate in Botswana. But, there are also occasions, such as the present case, when traffic officials have insisted that the smaller dimensions must be enforced. This is a serious inconvenience and extra cost to transporters.
For trade facilitation, Botswana must change its act to the larger dimensions, and, in the meantime, allow vehicles with those dimensions to operate freely. |

Introduction of electronic copies (for convenience) is still being considered. With this explanation, and that transporters can obtain permits easily, the NTB should be considered resolved |

South African-registered trucks are required to be escorted by the Mozambique authorities, from the Cuchamano border post, along the Tete Corridor, to their destinations. They are charged US$100 to the Zobue border post and US$150 to the Calomue border post.
Transporters have confirmed that they would prefer not to be escorted, as it delays their trips.
If the Mozambique authorities insist on escorting the vehicles, then the cost should be covered by Mozambique. Transporters should not have to pay for something that they do not want and it should be included in the Mozambique authorities' budget. |

Port Health at Nyamapanda, Zimbabwe, has issued a notice to the effect that all goods transiting the border are to be inspected, from 10th September.
The inspection in itself is not a problem.
However, a charge is to be levied for this inspection. This is unacceptable.
Port Health is a government department, which has a duty to perform, in the course of its daily work.
This duty is part of Port Health's daily workload and it budgeted for from Central Government.
Health inspections are done in the interests of the country and are not asked for by the transporter.
There should be no extra charge for this.
What would happen if every government department charged citizens for carrying out their daily duties? |

In 2011 the Cross-Border Road Transport Agency, raised its cross-border road transport permits by up to 600%.
Not only was this increase unjustified, but it was done without negotiation with the road transport industry.
The resultant costs are also out of line with the costs for road transport permits in other countries.
FESARTA sent a letter (attached) to the Minister of Transport in South Africa, copied to SADC, but no response was received.
The South African Road Freight Association (RFA) has taken legal action against the increases.
The resultant permit fees put unecessarily high increases on the costs to transport goods to landlocked countries.
This is against trade facilitation. |

Drivers of trucks that transport fertilizer from Beira to Malawi, are being attacked and killed along the Tete to Calomue route. Then the loads are being taken through the Calomue/Dedza border into Malawi, and sold there. The trucks are then abandoned. Drivers bodies are found by the side of the road days later. The Mozambique transporters are demanding urgent talks with the Sofala Governor, and commander chief of police, to enforce the patrol on the Beira corridor and find the killers.
It has happened three times:
• A Malawian fuel truck was hijacked and the driver and passenger killed a month ago
• Two weeks later, a truck loaded with fertilizer to Malawi, driver killed and load taken to the Malawi border, sold there and truck taken back to Tete bridge and abandoned
• Last week another truck with fertilizer was hijacked, driver killed and load taken to uncertain place
Satellite tracking has shown that the trucks are hijacked at Angonia village, not far from the Malawi border.
This most serious situation has to be dealt with urgently. |

On 17 Decemebr 2012, Mozambique Focal point reported that the Tax Authority of Mozambique did their due diligence in the central part, which resulted in the arrest of two culprits by the Police Authorities in Tete-Calomué-Dedza region. A detailed report from Mozambique Police authorities is given below :
1. The two arrested culprits (Names provided) have been brought before the courts and are responding criminally for their offences in the Courts of the city of Chimoio and Bárue respectively.
2. Investigations carried out by Mozambique Police found that the drivers themselves have created favorable environment for the Commission of such acts, by collaborating with culprits who generally were selling fuel siphoned from vehicles or tanks, and because these businesses cannot be performed often in villages, drivers ended up giving a ride to these people some of whom are criminals to places that they felt safer and then committed the crimes such crimes as charged.
3. Mozambique is therefore urging member states to adhere to regional transit agreements under the COMESA-EAC-SADC, and also urge the institutions or companies that exploit Mozambique highways to instruct their drivers not to collaborate with the criminals on the roads and not get involved in swindling their employers through selling fuel to street vendors on highways where they end up risking their own lives. |
