Complaint:	Small traders are denied certificates of origin by producers of products in cases where declarations by producers have to be given. ZIMRA has put in place a law where such declarations are denied which is against the protocol provisions
Resolution status note:	Zimbabwe reported that ZIMRA does issue certificates of origin. All certificates that are presented to ZIMRA for processing and the goods do meet the origin criteria are processed.

Complaint:	Cross border traders and exporters in general are not aware of the SADC FTA particularly the tariff reduction schedules.
Resolution status note:	The 10th SADC meeting of the Sub Committtee on Trade Facilitation held on 14-15 June 2012 noted that tariff data is available on the SADC website for the benefit of stakeholders and that Member States have the responsibility to undertake sensitisation in their respective territories to create awareness.

Complaint:	Non recognition given of ZIMBABWE standards as having equivalent outcomes by SADC countries Authorities
Resolution status note:	SADC Secretariat advised that there is no obligation for any country to recognize another country’s national standard in SADC. However if a standard has been harmonized at regional level, all SADC countries are expected to adopt and recognize that standard. Many national standards bodies adopt international standards as their national standards. It would be highly unusual and unexpected for one country not to recognize a national standard - which is an adoption of an international standard - of a second country

Resolution status note:	Botswana reported that Botswana standards are accessible and available through Botswana Bureau of Standards (BOBS). ISO, EN, BS and other standards from SADC member states and other regions are obtainable through BOBS. Anyone can access or obtain standards through BOBS at a fee.

Complaint:	Discrimination in goods clearance between small and commercial traders.The quantities that a trader carries determine the procedure to be followed in clearing goods through the border. Small traders into Malawi are clogging up the whole system and flooding up the whole market with commercial goods. Commercial traders are pushed out of the system because of the procedures that are applied at the port of entry.
Resolution status note:	Malawi reported that Customs clearing procedures are the same for small as well as commercial traders, but this could have been a one-off incident. However, now the Revenue Authority has an inland clearing system to overcome delays at the border and Malawi will continuously monitor the situation at the border to ensure smooth flow of goods and people

Complaint:	Cumbersome export certification procedures. The delays in going through the inspection process and approval process which takes a minimum of three working days, can be costly to exporters particularly for perishables. the process is that the Malawian importer seeks approval from ITS Malawi for inspection. ITS Malawi notifies ITS head office, which is in South Africa. Head office instructs ITS Zimbabwe and gives them authority to carry out the inspection at the Malawian Company's expense.

Complaint:	Zimbabwean exporters take longer to clear products at the Mozambique/Zimbabwe border. This is affecting particularly exports of fresh milk. This has limited Zimbabweans to exporting products that have a long shelf life into that country.
Resolution status note:	Mozambique reported that there are proper procedures for speedy clearance of fresh products, which ensure timely customs clearance and without damage to the economic operators. We will try to ascertain the situation and creating conditions that this does not happen again

Complaint:	In Mozambique, any wine consignment which is not escorted by police attracts a US$ 30 fine. It is not clear what the offence is and at what point the police should start escorting the consignments
Resolution status note:	Mozambique reported that monitoring tax is part of security measures and revenue assurance at risk, there are others situations like this, the most common being the provision of guarantee or security at the starting point of transit. The management system of transit guarantee of SADC, of which Mozambique is a signatory establishes the principle of extra-territorial validity of the warranty

Complaint:	Zimbabwe reported that Zambia is not issuing permits for the importaion of sterilized milk from Zimbabwe
Resolution status note:	Zambia reported that the Minister of Agriculture and Cooperatives in Zambia in 2007 suspended importation of sterilized milk until production, consumption and deficit figures were known so that whilst allowing imports , the diary industry which is in its infancy does not suffer but be allowed to grow. Consultations between the Ministry of Agriculture in Zambia and the Ministry of Trade and Industry in Zimbabwe are ongoing with a view to resolving the problem associated with the importation of sterilized milk from Zimbabwe.

Complaint:	Zambia has is now charging carbon tax of US$40 per trip an increase from the original US$40 per annum.
Resolution status note:	Zambia reported that she does not charge US$ 40 per trip but charges US$40 per every three (3) months and during that period payment is made only once regards less of how many trips are made until the three months expires.

Complaint:	When Zimbabwean goods are exported to DRC via Zambia, Zambian authorities require that a bond guarantee be deposited with Customs authorities to safeguard the goods in transit. Zambian authorities call for the bond guarantee to be paid in hard currency at port of entry but refunds are made in Zambian currency at port of exit. The Zambian currency may be of no use to the exporter in the country of destination of the products or country of origin.
Resolution status note:	Zambia reported that all payments to Zambia Revenue Authority (ZRA) are in Zambian currency (Kwacha). Based on existing legislation which is consistent with international best practices, all goods transiting through Zambia are expected to be on a transit document (and covered by transit bond/security) or a monetary deposit on all those without bond cover. With the newly introduced Electronic Deposit account system in place, clients who pay a deposit at Entry point are able to get the refund at the Exit point provided they comply with deposit conditions.

Complaint:	Lake harvest company was refused to export fish using kariba bridge on this particular date yet they were allowed to do so ,the man who was on interpol this day wanted some money from this company as bribe ,after refusal he denied to stamp the gate pass, this led to the fish to be bad and it was 4tonnes,all that fish perished as they took long in negitiating
Resolution status note:	At the 9th meeting of the SADC Sub-committee on trade facilitation, Zimbabwe reported that complaints relating to bribery should be reported immediately to the officer in charge for traceability and immediate action besides the online system for transparency. This could have been a once off incidence
