Complaint:	The Zambian Government is delaying implementation of phase down schedule of tariffs for imports of fishmeal under the SADC Trade Protocol.
Resolution status note:	Zambia reported that she is on schedule in terms of implementing her obligations under the SADC Trade Protocol. As a result of Zambia’s successful implementation of the Trade Protocol, Zambia participates in the SADC Free Trade Area. The tariff liberalization of category C is continuing up until 2010 as provided for in the SADC Trade Protocol.

Complaint:	Road blocks along the Northern Corridor for transporters carrying goods from Rwanda to Mombasa Port The policemen at road blocks demand payments of 1000 Uganda Shillings and 50 Kenya shillings. Once you have made the payments they don't even bother to check on what you are carrying.

Complaint:	Export levies of 15% is charged on unprocessed goat hides
Resolution status note:	Rwanda hs lifted the ban on exportation of raw hides and skins. However, the 5th EAC regional forum on NTBs held from 1-3 Septmber 2011 noted that the ban was appllied by all EAC countries with the aim to encourage value addition on raw hides towards export.

Complaint:	Weigh Bridges permanent and Temporary ones.... they do not respect the papers that state the weight carried so they force the drivers to weigh another challenge is that, there is no uniformity in the weights that the various weigh bridges present.
Resolution status note:	The 10th meeting of SADC Trade Facilitation Committee held onb 14-15 June 2012 accpeted Tanzania's explaination that problem arises due to packaging and loading of containers at the port. If containers are not properly packed, goods move while on transit and affect weigh on an axle. Distribution of weight on an axle may be correct at point of departure, but after some distance, it may change as cargo moves. Since weighing is on axles not cargo, different numbers may be recorded at a weigh bridge. It was reported that sensitization was already being undertaken to alert traders to reduce the possibility of movement of goods inside containers while in transit by packing properly.Tanzania is modernizing the weighing equipment so as to have electronic devices that cannot be tempered with and can keep records. This will contribute towards solving this problem. This NTb was therefore considered resolved on the basis of sensitization work in progress as well as modernisation programme.

Complaint:	Lengthy procedures for issuing work permits by Kenya, Uganda and Tanzania Immigration departments.As per BCI 2008 ,business take between 1-5 months to acquire work permits for workers sourced from another EAC country.Businesses are forced to employ locals who may lack required skills.

Resolution status note:	The 6th EAC Regional Forum on Non tariff barriers held from 12-13 March 2012, adopted recoomendation from the meetin of EAC permanent secretaries of the sectoral Council of transport , communications and metrology held in Nairobi on 16-19 August 2011 that a meeting of experts be convined by EAC secretariat to develop supportive legal, institutional and operative framework for approval by the council in 2012. This NTB is therefore considered resolved by the regional forum.

Complaint:	Varying application of axle load specifications by Kenya. Kenya demands that trucks should noit weigh more than 48Tonnes axle load whereas other partner states allow 56tons.
Resolution status note:	The axle load was agreed at 56 tons in the recent past and could possibly be a case where a hiccup arises due to lack of information by the implementing agency. When we have such cases of varying application of axle load specifications by Kenya along the Northern Corridor (Weighbridge), then it is useful to specify the weighbridge and give necessary details for us to follow and address the complain . However, the issue of varying application of axle load specifications should no longer occur because the region has adopted a uniform applicable axle load of 56 Tonnes

Complaint:	Tanzania has officially banned export of scrap metal to Rwanda
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012,Tanzania reported that it had ratified the Bamako convention that governs the movement of hazardous wastes with in Africa. Tanzania has neither banned importation nor exportation of scrap metals, but there are procedures to follow when engaging in such business which are : i) A team of experts has to inspect the scrap metals to ensure that the consignment is safe to and allowed to be exported. ii) The exporter has to obtain an export permit from the MIT. There are scrap metals that are not allowed to be exported from Tanzania. The list is supported by a Legal instrument. (The Exports Control Act Cap. 381, Prohibition of Exports, Amendment of the Schedule) Government Notice No. 204 published on 22/7/2005, Section 16). This applies to all countries not Rwanda specifically. During the Bilateral meeting Rwanda was availed with that specific legal instrument. With above explanation Rwanda withdrew complaint and it was agreed to consider it resolved

Complaint:	Certificates of origin are not provided at the borders between Rwanda and Uganda and cross border traders are obliged to collect them from Kampala for goods exceeding 500 US$. The long distance to Kampala is time consuming and additional cost to doing business.
Resolution status note:	At the Tripartite NTBs Online Reporting, Monitoring and Eliminating Mechanism Meeting to Launch the SMS Reporting Tool held from 9-10 April 2013 in Lusaka, Zambia, Uganda reported that Certificates are issued at the border so this NTB has been resolved. Rwanda intervened that it is only simplified certificate of origin for small scale traders that are available at the border but that for large scale traders has to be obtained from Kampala. Uganda undertook to confirm on whether Certificates of origin for large scale traders are available at the border.

Complaint:	SteelRwa was denied to import scrap metals from Tanzania due to the ban resulting from its scarcity in the region. Tanzania, Kenya and Uganda have banned exports of scrap metals not only to non EAC members but also the ban is applicable to other EAC member states

Complaint:	Removal of plate numbers on vehicles that have had accidents.The argument given is to force the driver to report to the police. The consequence is loss of goods and vehicle parts because with no plate number the truck/vehicle seems to belong to nobody.

Complaint:	The simplified trade regime to enhance cross border trade is not implemented since the simplified certificate of origin is not used. For the certificate of origin to be accepted, each country has to provide a list of products that regularly cross the border. Rwanda Revenue Authority on 16th September 2011, send a request to Tanzania asking for the list of common traded goods at our borders but did not receive a response.
Resolution status note:	At the 3rd meeting the Tripartite NTBs Focal Points and NMC Chairs held in Dar -es-Salaam on 19-20 April 2012,Tanzania reported that it launched the simplified trade regime at Rusumo border in March 2012. Tanzania has inaugurated and exchanged the list with Rwanda and the rate is no longer US$500 but US$2000 as from 16 March, 2012

Complaint:	Delays at Malaba border for trucks driving to Uganda due to lack of facilities at the border
Resolution status note:	The Focal points for Kenya and Rwanda reported that the scope of facilities reported missing at malaba include Air, Port, Rail, Road, Border Posts facilities and therefore making it quite difficult to address the NTB. It was therefore recommended that the NTB be removed from the system and any folow up complaint should be be reported accurately to reflect the true position of operations at the border in reference. Border posts facilities at Malaba are in place and operational.
