Description of the measure

1. The production and multiplication of propagating material of a protected variety as well as its packaging for the purpose of propagation, exhibition, sale, and marketing, exportation and importation shall be subject to prior authorization of the holder of plant breeder's rights.
2. The authorization for the exercise of any of the activities referred to in the previous number of this article is granted by means of a license, to be issued by the owner of the plant breeder's rights.
3. The holder of plant breeder's rights may impose certain limits and conditions for the exercise of the activities provided for in paragraph 1 of this article.
4. The conditions laid down in the preceding paragraphs of this Article shall also apply to varieties:
(A) Essentially derived from the protected variety, provided that the initial protected variety is not an essentially derived variety;
(B) Whose production requires the repeated use of the protected variety.
